Your spouse and you may be on good speaking terms and have discussed and agreed upon all issues and you simply need a legal agreement. This is simple enough but a lawyer has a duty to ensure your decisions were made with full information and that you are aware of what the law provides.

If these criteria are met, your lawyer or your spouse's lawyer will prepare the documents and the other spouse's lawyer will provide the other spouse with independent legal advice.

If what you are agreeing to is different to what the law provides or it is based on insufficient information, your lawyer will inform you of the inadvisability to sign such an agreement and the reasons why. If you still wish to sign the agreement, your lawyer will prepare an Acknowledgement for your execution which states that you were advised against signing the agreement and you were made aware of the consequences of signing such an agreement, yet it was your decision to sign it nonetheless.
